Va. – Nathaniel Wilburn, 35, of Ghent, was sentenced today to two years and nine months in prison, to be followed by three years of supervised release, for being a felon in possession of a firearm.
According to court documents and statements made in court, on October 30, 2024, law enforcement officers executed a search warrant at Wilburn’s residence and found a Hi-Point JCP .40-caliber pistol, a Charles Daily 12-gauge shotgun, a Ruger EC9 9mm pistol, and a Taurus 12-gauge shotgun. As part of his guilty plea, Wilburn admitted to possessing the firearms.
Federal law prohibits a person with a prior felony conviction from possessing a firearm or ammunition. Wilburn knew he was prohibited from possessing a firearm because of his prior felony conviction for breaking and entering in Raleigh County Circuit Court on November 15, 2023. United States Attorney Moore Capito made the announcement and commended the investigative work of the West Virginia State Police and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
Chief United States District Judge Frank W. Volk imposed the sentence. Assistant United States Attorney Brian D. Parsons prosecuted the case.
This case is part of Operation Take Back America, a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime.
